Rockfield Project Disposal of City Council Properties pt3 This proposal is also in accordance with the Housing Market Renewal Initiative within Liverpool. If the Council’s properties were placed into an auction for sale with no requirement for the purchaser to carry out specific works to the properties, it is likely that a capital receipt could be obtained. However, the objective of comprehensive renovation of properties in Rockfield would not be achieved.
The District Valuer has provided a valuation of the Council’s property on this basis in the total sum of £504,500 (averaging £42,000 per property). This would not represent value for money as there would be a likely future call on public sector resources as there is a strong likelihood that the properties will remain empty and be sold on again for investment purposes, until such times that the community demand that the public sector intervene once more. Under the Local Government Act 1972 (General Disposal Consent 2003), the Council can dispose of its property for a consideration less than can reasonably be obtained without seeking Secretary of State’s consent, providing that: a) The local authority considers that the purpose for which the land is disposed of is likely to contribute to the achievement of any one or more of the following objects in respect of the whole or any parts of its area, or of all or any persons resident or present in its area. i) the promotion or improvement of economic well-being ii) the promotion or improvement of social well-being iii) the promotion or improvement of environmental well-being b) The difference between the unrestricted value of the land to be disposed of and the consideration for the disposal does not exceed £2,000,000 (two million pounds). Executive Members: Councillor Marilyn Fielding, Councillor Keith Turner /Tony Hunter, Executive Director Recommendation: It is recommended that:-
2) The City Solicitor, in consultation with the Executive Director, Community Services, be authorised to complete all necessary legal documentation to complete the sale and refurbishment of the properties. 3) The use of 100% of the poolable part of the Capital Receipts including any overage received by the Council towards the provision of regeneration projects or affordable housing as permitted by the Land Authorities (Capital Finance and Account (England) Regulations 2003 is approved. Key Decision: Yes Forward Plan: Yes Implementation effective from: 5 October 2007 Timescale for action: Following approval of this recommendation the purchaser, Arena Housing Association Ltd, intends to complete the documentation and thereafter to secure the refurbishment of the properties as soon as possible in accordance with the phasing plan agreed by the community. Reason(s) for Recommendation: To secure the refurbishment of vacant Council/RSL properties in order to assist in achieving a key Housing Market Renewal Initiative outcome of increasing the proportion of owner-occupied property in the area. |
