From: THE TRIANGLE Received: 17/10/13 To: MARK KITTS Subject: Re: Your Email 17 October 2013 Dear Mark Thank you for your email, your apology is appreciated and accepted but with all due respect, we feel it is far too late in the day for us to consider it to be anything more than a token gesture. Don't take that the wrong way, we are happy to accept a token gesture as it has made for a refreshing change. We get the feeling that you are attempting to rebuild some burning bridges, if that is indeed the case then we are listening and the ball is in your court. Regarding the long term anti social behaviour instigated by your long term PARTNERS - LFC and Arena/Your Housing Group: we believe that your current and historic working relationship with said PARTNERS could be seen as a conflict of interest which would seriously question and potentially undermine your ability to remain impartial while officially adjudicating the merits of our accusations. We would like to state that we will adhere to and respect your decision to dismiss our claim even though you have not seen the full extent of the evidence. We are assessing our options with a view to either pursuing our claim of long term anti social behaviour via other means or pursuing a corporate negligence claim under environmental and Human Rights law. Mark, we would like you to note that, our motivation stems from the inability of the three elected ward Councillors, Cllr Annie O'Byrne, MP Steve Rotheram, yourself and many others, to tell the truth. We know the truth, but we had to prove it before we were taken seriously and to allow the average person to understand the obvious complexity of the issues that this community has been fighting against since the mid nineties. No one has ever helped the people, it's all LFC, LFC and a bit more LFC - this is our community not LFC's, they just happen to run a moderately successful business in the area, not in the community - the area! They are not Anfield, we the residents are Anfield! The quicker LFC accept that, the better it will be for all concerned. Your email suggested that our previous communication had enlightened us about your active liaisons with your partners and your plans, we had been well aware of your liaisons and your plans years before any of our communication took place. The only new knowledge that we gleaned from our short lived communications is that we should not trust you and you have a phobia of answering perfectly reasonable questions. Your timely apology has afforded you a glimmer of respect and we believe you have taken a positive step in the right direction. Kenworthy, Assistant City Solicitor Subject: Crime and Disorder Act 1998 1 November 2013 Dear Mr Kenworthy We are writing to you in an effort to allow us the opportunity to fully comprehend your email of 29/10/2013. Although we do not require further clarification from Justine Jenkins - Burke regarding the questions that she consistently refused to answer, we do have cause to challenge your email. Acting upon your role as Assistant City Solicitor you stated that anti-social behaviour only relates to "individual human beings" as described by the Crime and Disorder Act 1998 more particularly as “any person aged 10 or over”. We would like to respectfully challenge your statement that "any person" exclusively relates to a Human Being, the Crime and Disorder Act 1998 and the Anti-Social Behaviour Act 2003 do not include the word Human Being (see images below). The inclusion of the words "any person" is legally ambiguous and open to legal interpretation. Therefore, we would respectfully suggest that "any person" could well be interpreted as encompassing any legally defined person: Person: In general usage, a human being; by statute however, the term can include businesses, organisations, partnerships, associations, corporations, legal representatives, trustees, trustees in Bankruptcy, or receivers. For purposes of the constitutional guarantees of equal protection of laws and Due Process of Law - A Corporation is a "person" Every "corporate entity" is afforded legal status as a person: Corporate person-hood is the legal concept that a corporation may be recognized as an individual in the eyes of the law. This doctrine forms the basis for legal recognition that corporations, as groups of people, may hold and exercise certain rights under the common law and the UK Constitution. For example, corporations may contract with other parties and sue or be sued in court in the same way as natural persons or unincorporated associations of persons.
